A golfer accepts these when they create an account, claim a membership card, or check out.
1. The agreement
These terms are between you and GEM Peak Ventures LLC, doing business as The Middle Pin ("tMP", "we"). They cover your tMP account, your membership cards, the tMP app, and anything you buy through a course's tMP store or register. Our Privacy Policy is part of these terms.
2. Who you are buying from
When you buy a green fee, membership, lesson, event entry or pro-shop item, you are buying from that course or business, not from tMP. Its name is on your receipt and your card statement. Prices, refund policies, rain checks, membership rules and event rules are set by the course. Questions about a purchase go to the course first. We run the software and payments behind it.
3. Your account
You must be at least 13 to have an account. If you are under 18, a parent or guardian must agree to these terms for you, and only an adult can save a payment method or hold a charge account. Keep your password and register PIN private. One account per person: your tMP card is you, at every course you belong to.
4. Payments and memberships
Payments are processed by Stripe. Your saved card or bank account belongs to you and is kept by Stripe, not by us or the course. If you join a membership that renews, you authorise the course to charge your saved method on each renewal date at the price shown when you joined, until you cancel. The course will tell you before a price changes. Cancel through your account or by contacting the course.
5. Charge accounts
- A course may give you a charge account, so you can put purchases on your account and pay later. The course sets your limit.
- At each purchase you choose to pay now or put it on your account. Your usual choice is pre-selected; you can change it for any single sale.
- You authorise the course to charge your saved card or debit your saved bank account for your account balance on each settlement date (usually monthly). You'll get notice three days before each draft showing the amount and date.
- You may push a month's balance to the next month, but not two months in a row.
- If a draft fails, the course will retry and tell you. If your account falls two months behind, the course may pause charging on it until you settle. You can still play and pay by other means.
- You may load money onto your account ahead of time. A loaded balance is held by the course and used for your purchases first. Ask your course how it handles unused balances.
- Refunds on unpaid charges go back to your account. Refunds on charges already paid go back to your card or bank.
6. Tournaments, leagues and scores
When you enter an event, your name, flight, scores and finish may appear on the event's leaderboard and results, which can be public. If you post scores by scanning a code, your phone remembers the name you chose for a year so you don't have to sign in. Post only your own scores, honestly. Prizes and payouts are set and paid by the organiser.
7. Friends and the friends' tab
- You can invite people by email. Once you both say yes, you see each other's rounds, events and results, and your Golf Journey if you've shared it with friends.
- The friends' tab is a notebook for tracking who owes whom between friends, for example after a round. tMP holds no money and moves no money for it. You settle up yourselves, in cash or through apps like Venmo or Cash App, under their terms. Follow the law where you play. We may remove the tab or any entry we think is being misused.
8. Your content
Photos, rounds, journey pins, messages and other things you add stay yours. You give us permission to store and show them as you choose to share them (private, friends, or public). Don't upload anything you don't have the right to share, or anything unlawful, abusive or misleading.
9. Messages and AI
Messages you send through a course's chat go to that course. Some replies may be drafted by AI and approved by a person at the course. Some features, like the Caddie, answer from AI. AI answers can be wrong; check anything important with the course.
10. Closing your account
You can close your account at any time by emailing kevin@themiddlepin.com, and in the app when that feature is available. Before closing, settle any charge-account balance. We delete your personal information, except order, payment and tax records the law requires us or the course to keep, which are anonymised where possible.
11. Disclaimers and liability
The Service is provided "as is". To the extent the law allows, tMP is not liable for indirect losses, or for the goods, services or events a course provides. Our total liability to you is limited to $100 or the amount you paid through tMP in the 12 months before the claim, whichever is greater. Golf is a physical activity: your course's own rules and waivers apply on its property. Maps, weather and yardages are for information only.
12. Changes, law and contact
We may update these terms. We will tell you by email or in the app before material changes take effect. Colorado law governs these terms, and disputes go to the courts located in Colorado, unless the law where you live says otherwise. Contact us at kevin@themiddlepin.com.
